BakerCrate Affiliate Program Terms & Conditions

Thanks for your interest in the BakerCrate Affiliate Program ("Program"). By applying to and/or participating in the Program, you ("Affiliate," "you") agree to the terms below. Please read them before joining.
1. Eligibility The Program is open to individuals 18 or older who apply and are approved by BakerCrate. BakerCrate reserves the right to approve or decline any application at its discretion.
2. Your Affiliate Link & Discount Code Upon approval, you'll receive a unique affiliate link and a personal discount code through our affiliate platform (Refersion). Customers who use your code receive 10% off their entire BakerCrate order. Your link and code are for your personal use only and may not be shared as your own by another person or account, sold, or transferred.
Affiliate discount codes do not currently apply to subscription orders. This may change in the future, and Affiliates will be notified of any updates to this policy.
3. Commission Structure
You earn 10% commission on the net sale value of each order placed through your unique link or code.
Once you reach 5 qualifying sales, your commission rate increases to 15% and remains at that rate going forward.
Commissions are calculated on the product subtotal and do not include taxes, shipping, or amounts refunded or canceled.
Orders that are returned, refunded, or canceled will have any associated commission reversed.
4. Payment Commissions are paid out through Refersion's Unified Payments system. To receive payment, you must complete Unified Payments onboarding (Marketplace registration and selection of a payout method) as instructed in your welcome email. BakerCrate is not responsible for delayed or missed payments resulting from incomplete payment setup on the Affiliate's end.
If you earn $600 or more in commissions from BakerCrate within a calendar year, Refersion's Unified Payments will automatically generate and issue you a 1099-NEC tax form on BakerCrate's behalf. It is your responsibility to submit accurate tax information during Unified Payments onboarding so this can be issued correctly, and to report this income on your own tax filings. If you work with other brands through Unified Payments, you will receive a separate 1099 from each one.
5. Content & Usage Rights
By creating and sharing content featuring BakerCrate as part of this Program, you grant BakerCrate a non-exclusive, royalty-free, worldwide right to repost, reshare, and use that content, including photos, videos, and captions, across BakerCrate's organic and paid marketing, including but not limited to social media channels, website, email marketing, paid social advertising, and other marketing materials, in perpetuity, with credit to you where practical.
This right continues even if you later leave the Program, for content already shared with or posted about BakerCrate during your participation.
6. Disclosure Requirements You agree to comply with FTC guidelines and clearly disclose your affiliate relationship with BakerCrate on any content featuring our products (for example, using "#ad" or "affiliate" in your post or caption). This is a condition of participation, not optional.
7. Brand Guidelines & Prohibited Conduct
You may not:
Make false, misleading, or unsubstantiated claims about BakerCrate products, including health, dietary, or nutritional claims not authorized by BakerCrate
Use BakerCrate's name, logo, or trademarks in a way that implies you are an employee, official spokesperson, or that BakerCrate has endorsed content beyond your affiliate relationship
Bid on "BakerCrate" or confusingly similar terms in paid search advertising
Engage in spam, misleading coupon/deal site listings, or incentivized/fake engagement to drive sales
Post content that is discriminatory, sexually explicit, or otherwise inconsistent with BakerCrate's brand values
8. Independent Contractor Status You participate in the Program as an independent contractor, not as an employee, agent, or partner of BakerCrate. You are responsible for any taxes owed on commissions earned.
9. Term & Termination Either party may end participation in the Program at any time, for any reason, with or without notice. Upon termination, your affiliate link and code will be deactivated. Commissions earned on valid, non-refunded orders placed prior to termination will still be paid according to the standard payment schedule.
10. Product & Restocks Initial starter product is provided at BakerCrate's discretion. Additional product restocks are based on Affiliate activity (posting consistency and sales performance) and are not guaranteed on any fixed schedule.
11. Changes to These Terms BakerCrate may update these Terms from time to time. Continued participation in the Program after changes are posted constitutes acceptance of the updated Terms.
12. Limitation of Liability BakerCrate's total liability to you under this Program is limited to unpaid commissions properly earned and due. BakerCrate is not liable for indirect, incidental, or consequential damages arising from your participation.
13. Acceptance By submitting an application to the Program and/or by continuing to participate after approval, you confirm that you have read, understood, and agree to these Terms & Conditions.

BakerCrate Affiliate Privacy Policy

This policy explains what information BakerCrate collects from Affiliates who join our Affiliate Program, how it's used, and who it's shared with. It applies in addition to BakerCrate's general Privacy Policy.
1. Information We Collect
When you apply to and participate in the Program, we (and our platform partners) may collect:
Contact information you provide on application (name, email, social handles, follower/audience info)
Account activity data (clicks, referral link usage, discount code usage, conversions, sales attributed to your account)
Payment and tax information required to process commissions, including identity verification (KYC) details and tax ID information, collected directly by Refersion and its payment partner, Dots, as part of Unified Payments onboarding
Content you create and share featuring BakerCrate, to the extent you tag, submit, or share it with us
2. How We Use This Information
We use this information to:
Review and approve affiliate applications
Track sales and calculate commissions owed
Process and send commission payments
Communicate with you about your account, payments, product shipments, and program updates
Comply with tax reporting requirements (including issuing 1099 forms where applicable)
Improve and manage the Affiliate Program
3. Who We Share It With
Refersion (our affiliate tracking platform) processes your application, link/code activity, and commission data
Dots, Refersion's payment partner for Unified Payments, processes identity verification (KYC), tax information, and payment/payout details on our behalf. Dots maintains its own security and compliance standards for this data
We do not sell affiliate personal information to third parties
We may disclose information if required by law, or to protect BakerCrate's legal rights
4. Payment & Tax Data
Identity verification and tax information submitted during Unified Payments onboarding is collected and stored by Refersion/Dots, not directly by BakerCrate. BakerCrate receives confirmation of your verification and payment status but does not store your full tax ID or banking details.
5. Data Retention
We retain affiliate account and transaction data for as long as needed to manage the Program, calculate and pay commissions, and meet tax and recordkeeping obligations, even after you stop participating in the Program.
6. Your Choices
You can request a copy of the information we hold about you, ask us to correct it, or request account deactivation by emailing [email protected]. Some information (such as tax records tied to payments already made) may need to be retained regardless, for legal and accounting purposes.
7. Security
We rely on Refersion and Dots's security measures (including encryption and bank-level security protocols) to protect sensitive payment and identity data submitted through Unified Payments. No system is 100% secure, and we encourage affiliates to safeguard their own account credentials.
8. Changes to This Policy
We may update this policy as the Program evolves. Continued participation after changes are posted means you accept the updated policy.
